A class action lawsuit has been filed claiming that Coventry Health Care of Kansas violated Missouri law and the Employee Retirement Income Security Act or ERISA when they imposed certain copayments for prescription drugs to individuals under the Coventry Missouri HMO plan. The lawsuit is in the jurisdiction of the United States District Court for the Western District of Missouri. The honorable Judge David Gregory Kay will reside over the case. A settlement fairness hearing has been scheduled for October 10, 2012 at 9:00 AM. Please note you do not have to attend this hearing in order to collect a settlement. The hearing will decide if the Settlement Fund in the amount of $2,666,000 is fair and appropriate. Under the current settlement terms each valid class member will receive a settlement payment equal to their pro rata share of the Excess Copayment. The payment must be cashed within 120 days or it will become void. Court documents are available at the class administrators web portal and Adobe will be needed in order to download the documents. All objection and exclusion request are due no later than September 4, 2012. If you exclude yourself from the settlement you will not be eligible for any type of settlement payment under the Holling-Fry v. Coventry Settlement and you will have to hire your own lawyer.
