Honda Odyssey Torque Converter Class Action Lawsuit

If you purchased a 2005 through 2009 Honda Odyssey you could be a class member of the Honda Odyssey Torque Converter Class Action Lawsuit.  The lawsuit is entitled Laura Heintz v. American Honda Motor Co., Inc. and is case number CV11-09311.  The lawsuit claims that Honda sold these Odyssey vehicles with a defective torque converter.  This defect prevented some of the autos from accelerating or maintaining their speed via the lawsuit.  Furthermore the lawsuit claims that this is in violation of the California Consumer Legal Remedies Act, violations of unfair business practices act, fraud, breach of written warranty under the Magnuson-Moss Warranty Act, and breach of express warranty under Cal. Com. Code section 2313.  The case is in the jurisdiction of the United States District Court for the Central District of California.

Acer is a target of a class action lawsuit that claims they marketed computers with a specific type of Microsoft Windows version but the computers did not contain the Microsoft Windows program as advertised but a lesser-equipped version.  This “lesser-equipped version” of Windows did not include a full system recovery option which resulted in damage to the hard drive in some of the computers.  Acer denies all allegations but has agreed to settlement terms.  The lawsuit is entitled Embry v. Acer America Corporation and includes anyone who purchased an Acer computer in the United States between March 24, 2005 and May 1, 2011. 

In order to be part of the settlement you MUST file a claim form.  The form can be downloaded from the class admin website and mailed to Claim Administrator, PO Box 2639, Faribault, MN 55021-9639.  Claim forms are due no later than March 14, 2012, or 30 days after the Court grants final approval of the settlement, whichever is later.  A settlement fairness hearing will be held at Courtroom 15, 18th Floor, 450 Golden Gate Avenue, San Francisco, California 94102 on 02/13/2012.  If you wish to object to the settlement please do so no later than 01/23/2012.  All objections must be filed with the court.  The objection can be filed online at ecf.cand.uscourts.gov or in person at the Clerk’s Office, United States District Court for the Northern District of California, 450 Golden Gate Avenue, San Francisco, CA 94102.

A class member who files a valid claim form could receive free software, hardware, service and/or cash refunds from the Acer computer class action settlement.  Class members will fall into either settlement Group A, B or C.  The group you are in determines the settlement award.

The Discount Tire rebate center allows a customer to check on the status of a rebate, claim a rebate and manage their DTC account online.  To claim a rebate please have the offer code, the invoice number, the transaction date and your customer phone number on hand.  The offer code number should be five digits in length without any spaces or dashes.  The invoice number should be 7 digits in length.  The information provided will then be matched up the DTC invoice rebate system.  Rebates will be mailed first class and will take about 3 to 4 weeks to show up.  If you prefer to mail or fax you rebate in please do so by:

A class action lawsuit is pending in the United States District Court for the Central District of California against Welch’s for claims that the Welch’s 100% Juice White Grape Pomegranate flavored juice blend was advertised and marketed in a deceptive way to customers.  According to the settlement notice Welch’s marketed the White Grape Juice in a way that made consumers believe there was more pomegranate juice than there actually was.  In other words the customers thought they were getting a lot of pomegranate juice when they only got a little. 

The case is entitled Courtney v. Welch Foods, Inc., SA CV 10-01427-AHM and includes anyone who purchased Welch’s 100% Juice White Grape Pomegranate Flavored Juice Blend from 07-01-07 to the present time.  If a class member fills out a Refund Claim Form and provides a receipt of purchase they will receive a full cash refund of the retail purchase price for all WGP Product purchases under the terms of the Welch’s White Grape Juice Blend Class Action Lawsuit Settlement.  All claim forms must be in by December 31, 2011 and there is no limit to the amount of claims if you have a receipt.

If you do not have a receipt you can still make a claim for a coupon for a free Welch’s 100% Juice, 64 ounce juice product (limited one claim per household).  These settlement coupons will only be offered until 12-31-11 or until 15,000 of the coupons have been issued, which ever comes first.

Welch’s will also offer discount coupons, which may be redeemed by anyone, without proof of purchase.  These coupons will be made available in Sunday newspapers.  The total value Welch’s is committing to honor through these coupons is not less than $30,000,000.

Welch’s will also provide $350,000 worth of food and juice products to charities as part as the settlement terms.

The site is simple to use and most documents on www.dmv.state.pa.us  require Adobe Acrobat Reader to view and print. 

 To perform a vehicle transaction online you will need: the first eight digits of your title number, your plate number, your driver license number, a valid form of payment, proof of insurance information and a working printer.  Forms of payments that are accepted include credit or debit cards issued by Visa, MasterCard, American Express and Discover.  Once you have registered online it will take approximately 10 business days to receive your card in the mail.  If you need a duplicate registration card and/or renewal sticker you must complete form (Form MV-44) ‘Application for Duplicate Registration, Replacement of Registration Plate, Renewal Sticker or Weight Class Sticker or Transfer of Registration’.  The form should only take a few minutes to file.

The Classmates.com Class Action Lawsuit is entitled In re Classmates.com Consolidated Litigation and revolves around claims that Classmates.com sent emails to subscribers that violated the law and the privacy rights of subscribers. The lawsuit is in the jurisdiction of the United States District Court for the Western District of Washington and is case number 09-45RAJ.

MF Global Class Action Lawsuit

A lawsuit has been filed against MF Global soon after they announced they were filing for Chapter 11 bankruptcy protection.  The lawsuit was filed by angry investors who purchased MF Global securities.  The investors claim that MF Global and its former chairman, CEO and New Jersey Governor Jon Corzine, violated federal securities laws and artificially inflated MF Global’s stock price.  This resulted in the investors feeling more confident about the stock and its price then they should have been.  The lawsuit is entitled Joseph DeAngelis et al. vs. Jon S. Corzine et al. and was filed by the law firm of Block & Leviton L.L.P who are based in Boston MA.  The lawsuit will be in the jurisdiction of the Federal District Court in New York.

The Apple MacBook & MacBook Pro & MagSafe “T” Power Adapter class action lawsuit is entitled “In re Magsafe Apple Power Adapter Litigation” and revolves around claims that the 60W or 85W MagSafe MPM-1 (“T”) Power Adapters used with an Apple MacBook or MacBook Pro computers is defective and that it “dangerously frays, sparks and prematurely fails to work,”.  The lawsuit further claims Apple falsely misrepresented the product.  Apple denies all wrong doing.  The case is in the jurisdiction of the United States District Court for the Northern District of California, San Francisco Division and is case number C09-01911-JW.

The settlement class according to the lawsuit is defined as:

“All United States residents who (1) are the original owners of an Apple MacBook or MacBook Pro computer that shipped with a 60W or 85W MagSafe MPM-1 (“T”) Power Adapter (“Subject Computers”) and/or (2) purchased a standalone 60W or 85W MagSafe MPM-1 (“T”) Power Adapter. The Settlement Class includes original owners who received their Subject Computer(s) as a gift.”

Even though Apple denies the allegations they have agreed to a settlement in order to avoid any further court cost.  Under the proposed settlement terms cash payments will be made in the amount of $35.00, $50.00 and up to $79.00 depending on the year of the purchase of the replacement adapter.  You MUST file a claim before March 21, 2012 in order to be eligible for any type of settlement payment.  A claimant will also be asked to sign the claim form under penalty of perjury.  Claim forms can be found at the class administrators web portal. 

A settlement fairness hearing is scheduled for February 27, 2012 at 9:00 a.m. to determine if the settlement is fair.  The hearing will be held at the United States District Court for the Northern District of California, San Francisco Division, Courtroom 9 (19th Floor) located at 450 Golden Gate Avenue, San Francisco, California, 94102.  If you wish to speak at the hearing you must file a formal request to do so.
