Quaker Oats Deceptive Advertising Class Action Lawsuit

Quaker Oats has a problem on their hands.  A Federal Judge ruled they must face a class action lawsuit claiming that they marketed certain products to be “heart healthy” when in all actuality the products contain unhealthy trans fats!  An example of this would be the Quaker Oats Chewy Granola Bars.  These bars were marketed as a health product when they are really anything but.  You might as well eat a Snickers bar.  Heck a Snickers bar might actually be better for you than one of those Chewy Granola Bars.   The lawsuit is entitled Daniel Askin v. The Quaker Oats Company and is in the jurisdiction of U.S. District Court, Northern District of Illinois, Eastern Division.

Consumers of the Quaker products paid a premium price for the products because they believed they contained zero grams of fat.  Had the consumer known about the reality of the products they would have not made the purchase.  Trans fats are one of the worse things to consume on the planet.  They contribute to heart disease, Type 2 diabetes and cancer!  But please note this lawsuit is not about the health of the bars. The court disagreed, ruling “regardless of whether [Plaintiff] was physically harmed by the products he consumed, he alleges that he would not have purchased them absent the allegedly misleading statements” that the products did not contain trans fats. “That allegation states the kind of economic injury that is redressable through this suit.”

NBA Players Lockout Class Action Lawsuits

The NBA lockout has gone from bad to worse.  David Stern has to be sick to his stomach right now.  Some NBA players not only are receiving offers to play overseas but now they have filed a class action lawsuit against the NBA claiming David Stern’s ultimatums left them no other choice.  This has turned just plain ugly.  The lawsuit is entitled Anthony v. NBA and Butler v. NBA.  The two lead plaintiffs Carmelo Anthony (a star player for the New York Knicks) and Caron Butler.  “The collective bargaining process and relationship have completely broken down, and the NBA players have exercised their labor right not to be in a union,” says Butler’s NBA lockout class action lawsuit. “The consequence is that any labor exemption to the antitrust laws no longer applies.”  The players are demanding  triple the amount of the more than $2 billion they would have made under a full 2011-2012 season!  The players seem to be the ones to blame in this lockout. 

You would think the NBA would have just took a page out of the NFL lockout playbook and came to some sort of agreement.  The NBA has enjoyed a nice comeback over the last few years and ratings have been really good.  Unlike the NFL, the players could not come to an agreement with the NBA owners.

Sony Electronic offers some of the best customer service known to mankind, no joke.  These guys must go to school to become customer service agents they are so good.  If you ever have a problem with a Sony product eservice.sony.com is the place to go.  For new Sony Product repairs please have you’re the product model number, the purchase date, and the zip code in which the product was purchased.  For existing repairs please have the Event ID or Work Order Number in order to proceed with your search.  Examples of the event id or word order number include E00000000 (Event ID – 9 characters), V0000000 (Work Order Number – 8 characters), W0000000 (Work Order Number – 12 characters).  TV, computers, headphones, CD players, cameras and camcorders are all common products that require Sony eServices. 

If you just need help getting a product to work Sony eServices provides helpful tutorial instructions.  Even my Grandma could figure out how to use the most complicated device with these easy to understand tutorials.  Video tutorials are available for certain products as well.  If the product is not that hard to use or not that popular you will most likely not find a tutorial for it.

A lawsuit was filed against Sketchers claiming they violated California state law by asking customers for their addresses, email addresses and phone numbers at the time of check out to those using a credit card to make a purchase.  The settlement provides a $15-off or $20%-off Merchandise Certificate to eligible class members who file timely claim forms.  Class members of the Sketchers Store Class Action Lawsuit Settlement include anyone who made a purchase at a California Sketchers store (including Sketchers retail stores, concept stores, factory outlet stores and warehouse stores) between April 22, 2009 and November 11, 2011.  The lawsuit is entitled Pomerants v. Sketchers USA and is in the California Superior Court, County of Los Angeles.

All claim forms are due no later than April 19, 2012.  A fairness hearing will be held on February 7, 2012 at Department 311 of the Los Angeles County Superior Court, located at the Central Civil West Courthouse, 600 South Commonwealth Ave., Los Angeles, CA 90005.   The hearing will start at 9am.  All objections and exclusions are due no later than January 10, 2012.  The class counsel can be reached at:

It was a long hard battle but class members are starting to get paid part of the $276 million settlement agreement in relation to an alleged conspiracy amongst the major credit card companies to conceal markups and fees, typically 1% to 3%, on foreign transactions.  The credit card companies involved in the lawsuit included Visa, MasterCard, Bank of America, Bank One/First USA, Chase, Citibank, Diners Club, HSBC/Household, MBNA and Washington Mutual/Providian. Over 10,000,000 claims were submitted in the Credit Card Foreign Transaction Fee lawsuit and they will receive a check in the mail by the end of the year.  Most class members will receive around $18 from the credit card foreign fee class action settlement.

More trouble is on the horizon for Netflix.  A class action lawsuit has been filed against Netflix and Wal-Mart Stores Inc. and Walmart.com involving the price of online DVD rentals.  The lawsuit is entitled Online DVD Rental Antitrust Litigation and is in the jurisdiction of the United States District Court for the Northern District of California (www.OnlineDVDclass.com).  Anyone who paid a subscription fee to rent DVDs online from Netflix anytime from May 19, 2005 to September 2, 2011 is considered a class member.  Please note that this does NOT include free trial offers.  Emails are currently being sent to class members in the lawsuit. 

The Wal-Mart and Netflix DVD Class Action Lawsuit revolves around claim that Wal-Mart and Netflix conspired and reached an unlawful agreement under which Wal-Mart would withdraw from the online DVD rental market and Netflix would not sell new DVDs.  This action resulted in higher prices for DVD rentals according to the lawsuit.  Netflix and Wal-Mart deny all wrong doing in the case. 

Wal-Mart however has agreed to settlement terms in order to avoid any further court cost.  Wal-Mart will pay $27,250,000, in cash and gift cards, to those who qualify as a class member.  In order to participate in the settlement you must file a claim form before February 14, 2012.  Claim forms can be found at OnlineDVDclass.com or by calling toll-free 877-389-4469 and request a form by mail.   If you wish to exclude yourself or object to the settlement you have until February 14, 2012.  A settlement fairness hearing will be held on March 14, 2012 to determine of the settlement is fair and reasonable.  The hearing will be held at the United States District Court for the Northern District of California, located at 1301 Clay Street, Oakland, CA, 94612, in Courtroom #3.  This is for the Wal-Mart settlement only.  The Netflix trial  is scheduled to begin on January 23, 2012. If you wish to remain in the Netflix Litigation Class, you do not need to take any action at this time. If there is a recovery from Netflix, you may receive further instructions at that time.
