Here is another class action toy lawsuit for the books. The Mega Brands Class Action Lawsuit is entitled Berry and Doering v. Mega Brands, Inc., et al and involves the MEGA Brands Magnet Toy. The lawsuit claims that the MEGA Brands Child Magnet Toys are defective due to the toy containing a small magnet that may be become loose. The magnet becoming loose may cause for a safety hazard for a child.
The Mega Brand toys included in this lawsuit are as follows:
Magnimals, Magtastik, Magtastik, Magnetix, Magnaman, Magna-Wheels, Magnaworld, Magna-Bugs, Magna-Saurs, Magnalogs, iCoaster/iPark, Magna-Formers, Spheron, Magna-Bones and Mag-Warriors.
The lawsuit is pending in the United States District Court for the District Of New Jersey and includes anyone who purchased a MEGA Brands Magnet Toy since September of 2003. Cash payments will be made to those who file valid claims according to the settlement terms. $5 for each MEGA brands recalled Toy returned up to $15.00. If the class member has the original receipt a full refund might be provided.
A fairness hearing will be held on December 15, 2011, at 11:00 a.m. before the Honorable Susan D. Wigenton, United States District Court Judge, at the United States District Court for the District of New Jersey Martin Luther King, Jr. Federal Building & U.S. Courthouse, Newark, New Jersey 07102 if you wish to attend.
